Eligibility and work outside the package

The package applies to one trademark filed in up to two classes that meets the use-in-commerce requirement. Contact us to confirm eligibility and obtain a quote. Substantive work, including substantive refusals, oppositions, appeals and litigation, and all portfolio management are billed at our current hourly rates. Additional marks are outside this package. Intent-to-use applications and later use-related filings follow a separate fee schedule; contact us for the applicable fees.

How a search fits into the fee

The search comes before the filing decision. An attorney reviews the findings with you so potential conflicts and other concerns can be considered before proceeding. A search or application does not guarantee registration; the USPTO makes that decision. See the registration timeline and clearance-search guide.

Questions about trademark registration cost

Does the $2,700 include USPTO fees?

No. Base USPTO filing fees are $350 per class, and additional government charges may apply. The attorney fee and government fees are shown separately so you can compare the expected scope and total.

Will a substantive office action cost extra?

Substantive refusals are outside this package and billed at our current hourly rates. We will discuss scope before undertaking that work. Read about office action responses.

Can I include my business name and logo in one package?

A name and a logo may require separate applications depending on the protection sought. The package covers one mark. Bring both versions to the consultation so we can discuss priorities and pricing.

How much does it cost to hire DBA for a trademark application?

Our qualifying use-in-commerce search-and-application package is $2,700 in attorney fees for one mark in up to two classes. Base USPTO application fees are currently $350 per class, so the starting totals are $3,050 for one class or $3,400 for two, before additional fees or out-of-scope work. Contact us to confirm eligibility and scope.

Can USPTO charges exceed the base application fee?

Yes. Additional charges can apply when an application lacks required information or uses custom goods-and-services wording instead of an available ID Manual entry. Fees also depend on the filing and procedural step. Review the actual application and current USPTO fee requirements before treating a base fee as the final government cost.

USPTO — Additional application fees

Can I apply before launch, and how does DBA charge for intent-to-use work?

A bona fide intent to use a mark can support an intent-to-use application before the required commercial use begins. Intent-to-use matters follow our separate fee schedule; contact us for the applicable fees and scope, including later use-related filings. They are not covered by the advertised $2,700 use-in-commerce package.

How does DBA charge for a trademark office-action response?

Standalone office-action response work and substantive refusals are billed at our current hourly rates. A nonsubstantive response expressly included in an existing qualifying registration package remains within that agreed scope. Appeals and other substantive work are hourly. Send the complete USPTO letter and serial number so we can evaluate the issue, deadline and engagement terms.

How does DBA charge for trademark portfolio management?

Portfolio management is billed at our current hourly rates. That includes separately scoped reviews of multiple marks, ownership records, renewal planning, brand expansion and transaction-related trademark issues. Contact us with the list of marks, registration numbers and business priorities so we can define the work. This is outside the $2,700 single-mark application package.
