A brand that can keep up with the product.
For a Bay Area software or AI business, the product may change faster than the pitch deck. We help you choose trademark priorities around what customers receive today and where the business is heading.
One platform, several offerings
Downloadable software, hosted tools, and consulting may share a name without being the same offering. We help align the filing plan with the actual customer experience.
As the product evolves
A pivot, new model, or additional feature can change which names matter most. We can review the brand portfolio so your next launch builds on a clear understanding of existing protection.
A few questions before we begin.
Can I trademark the name of an AI app in the Bay Area?
A source-identifying app name may be eligible, but clearance, distinctiveness, and the identified goods or services matter. A description of what the AI does may be weak or unregistrable without additional circumstances. Review the name before a public launch; receiving a domain or app-store listing is not trademark clearance.
USPTO: strong trademarks
Do SaaS and downloadable software need the same trademark coverage?
Not necessarily. Hosted software services and downloadable software are treated differently in trademark identifications. Describe the function, delivery method, and customer use of each offering. Counsel can then assess suitable wording and classes rather than assuming that one software label covers every product format.

Should the founder or startup company own the application?
The applicant must be the correct legal owner for the filing basis and circumstances. Do not choose the founder simply because that person bought the domain or created the account. Identify the operating entity and relevant agreements first; naming the wrong applicant can cause problems that cannot always be corrected later.

What if we pivot the product after filing an intent-to-use application?
Tell counsel before assuming the existing filing still fits. The mark, owner, and identification need review, and an application generally cannot be broadened to cover new goods or services outside its original scope. Intent-to-use work follows DBA’s fee schedule; portfolio restructuring and substantive advice are billed at current hourly rates.

Should we file an AI model name that may change after our next funding round?
Compare the expected life of that name with the platform and company identities. Prioritize marks supported by an actual business plan, then discuss whether to wait, clear alternatives, or file. Portfolio advice is hourly; intent-to-use work follows our separate fee schedule.

What should a Bay Area startup document before letting a partner rebrand its tool?
Prepare the proposed customer screens, partner agreement, attribution language, and list of names each party will use. We can assess which identity identifies your offering and which belongs to the partner before the distribution arrangement goes live.
Substantive advice, substantive office-action responses, and portfolio management are billed at our current hourly rates. Intent-to-use matters follow a separate fee schedule. See pricing and scope.
