Before the label reaches a wider audience.
A New York brand can move from a studio or showroom to wholesale orders quickly. We help you assess the name before production, packaging, and retail commitments lock it in.
The collection and the continuing brand
A seasonal collection, a slogan, and the house label do different jobs. We help identify which names function as lasting brands and which deserve filing priority.
Protect the identity across collaborations
Manufacturers, retailers, and creative partners may all use your name. We can help clarify ownership and permitted use as your products reach new channels.
A few questions before we begin.
Is a slogan across the front of a shirt enough to register a clothing trademark?
Not necessarily. The USPTO can treat prominent wording as decoration rather than a source identifier. How the mark appears on labels, tags, or other genuine uses can matter. Bring the actual merchandise and labels to counsel; do not create a mockup and present it as evidence of real commercial use.
USPTO: ornamental refusals
Should a New York retailer register its store name and product label separately?
It depends on which marks identify which goods and services. A retail service name, private-label apparel brand, and logo may call for different applications or coverage. List each commercial use before deciding. Trademark class numbers organize applications; they are not blanket ownership of every business activity in a class.
USPTO: goods and services
What if another New York brand has a similar name but sells a different product?
Different products do not automatically eliminate risk. The question includes whether the goods or services are related and whether consumers could believe they come from the same source. Share both parties’ products, sales channels, and branding with a trademark attorney before investing in a launch or sending a demand.
USPTO: likelihood of confusion
How our trademark searches work
Can DBA handle a USPTO refusal for an existing New York application?
Yes, subject to conflict review and engagement. Send the serial number, complete office action, and deadline. We assess the refusal and available response rather than promise approval. Standalone office-action matters and substantive responses are billed at current hourly rates; they are not included merely because a flat-fee application package is advertised.

Should a New York label file every seasonal collection name?
Start with names intended to last beyond a season and the identities customers recognize as the source. Review the collection plan alongside the house mark, expected reuse, and clearance results. A short-lived title and a continuing product-family brand may warrant different investment.
Trademark registration and filing guidance
Who should approve a collaboration name before a New York wholesale launch?
Identify the label owner and collaborator, then review approval rights, permitted products, and what happens to remaining stock after the collaboration ends. Bring the draft agreement before production. Licensing and ownership advice is hourly.
