A name that can travel beyond Colorado.

A Denver outdoor or consumer-products brand may be ready to move from local sales into wholesale distribution. We help you assess the identity before new packaging and inventory commitments.

The place and the brand

A mountain or destination name can describe the inspiration without doing all the work of a distinctive brand. We help evaluate the wording customers will rely on to recognize your business.

From experiences to your own gear

Adding private-label products can raise questions beyond an existing service or store name. We help assess that next step before the label reaches production.

A few questions before we begin.

Can a Denver business register a brand containing a geographic term?

It depends on the mark, its geographic meaning, the products or services, and other facts. Geographic wording can raise descriptiveness or other refusal issues. Have counsel assess the entire name instead of assuming a city or mountain reference is automatically protectable.

USPTO: possible grounds for refusal

Does our store registration cover our private-label outdoor gear?

Not necessarily. Retail services and the goods sold under a private label are different activities. Identify each actual or planned branded product and select supported coverage. A registration is not blanket protection for everything sold in the store.

USPTO: goods and services

Trademark registration and filing guidance

Should we file a new application after changing our package logo?

It depends on what was registered and the extent of the change. Standard-character and special-form marks provide different forms of coverage, and not every change can be made within an existing registration. Review the proposed redesign before printing inventory.

USPTO: mark drawings

Trademark registration and filing guidance

What trademark records should a buyer of a Colorado brand request?

Review registrations, applications, actual use, ownership history, licenses, and maintenance status. A certificate alone does not answer whether the portfolio reflects the business being purchased. DBA’s portfolio and transaction analysis is billed at current hourly rates.

USPTO: maintaining registration

What should a Denver outfitter review before putting its name on private-label gear?

Bring the current trip-service materials, proposed hangtags, and manufacturing terms. Assess the product brand before ordering inventory, and identify whether the new goods need additional coverage. The filing plan should follow the actual gear sold under the name.

USPTO: goods and services

Should a Colorado place name be the main brand for a national gear launch?

Consider whether the wording will distinguish your business or primarily communicate a place or product characteristic. Compare alternative names before packaging and distributor commitments. The precise geographic meaning and goods matter; local popularity alone does not settle registrability.
