From a familiar favorite to a wider market.

A Chicago food or consumer-products business may be ready for its first retail order or a new distribution channel. We help address the trademark questions before packaging and production commitments grow.

The restaurant name and the retail label

Dining services, bottled sauces, and other products can call for different coverage. We help assess how customers will encounter each brand.

Your label, your manufacturing relationship

Private-label and co-packer arrangements should leave the brand’s ownership clear. Our team can help address use of the name as products move between manufacturers and retailers.

A few questions before we begin.

Can a Chicago restaurant use the same filing for bottled sauces and dining services?

Do not assume so. Restaurant services and packaged food products are different commercial offerings and can fall in different classes. List what is already sold and what is only planned. Counsel can assess whether to file for both, use different filing bases, or stage the applications as the business expands.

Trademark registration and filing guidance

Does a different recipe avoid a conflict with another food trademark?

Not by itself. Trademark analysis focuses on the brands and the relationship between the goods or services, including how consumers encounter them. A sauce, seasoning, restaurant, or related offering can require a closer look even if ingredients differ. A clearance review should reflect the proposed sales channels.

USPTO: likelihood of confusion

How our trademark searches work

Can our manufacturer register the trademark for our private-label product?

The correct applicant depends on ownership, not merely who manufactures or prints the packaging. Identify the legal entity that owns the brand and review the agreements before filing. If responsibilities are unclear, resolve them rather than choosing an applicant for convenience. Ownership mistakes can jeopardize an application.

USPTO: common application problems

Trademark portfolio and ownership guidance

What specimens should a Chicago consumer-products company keep?

Keep authentic photographs of the goods, labels, or packaging as sold, and relevant ordering-page records. The evidence should connect the mark to the claimed goods. A digitally altered product image or proposed package is not a substitute for actual use. Requirements depend on the goods, services, and filing basis.

USPTO: specimens of use

Trademark registration and filing guidance

Is federal registration useful if we currently distribute only around Chicago?

Potentially. Federal registration can provide important nationwide benefits, but eligibility and the extent of rights depend on the facts, including the filing basis and other parties’ rights. Share planned retail and online expansion with counsel. A federal application should not be treated as permission to ignore an earlier user.

USPTO: benefits of federal registration

Trademark registration and filing guidance

Does a retailer’s private-label order replace the need to protect our Chicago house brand?

Treat the buyer’s brand and your own consumer-facing brand as separate assets. Bring both product presentations and the manufacturing agreement. The filing priorities should follow which names you own and will continue using after the retailer relationship ends.

What should a Chicago food company review when one name moves from a café to grocery packaging?

Compare the café service identity with the packaged-product label and the goods you will actually sell. Assess the scope before the print run; a service filing should not be assumed to describe the new products.
